1. Acceptance of Terms
By using LunitonAI (the "Services"), creating an account, or installing our Shopify app, you agree to these Terms of Service ("Terms").
If you don't agree, please don't use our Services.
If you're using LunitonAI for a business, you confirm you have the authority to bind that business to these Terms.
Important: Our Services require a Shopify store. You must have or create a Shopify store to use LunitonAI.
2. Your Account
2.1 Who Can Use LunitonAI
- You must be at least 18 years old
- You must operate a legitimate business
- You must comply with all applicable laws
2.2 Registration
To use LunitonAI, you need to:
- Provide accurate information (name, email, business details)
- Connect your Shopify store through our app
- Keep your information up to date
We'll use your email as the main way to contact you about your account, billing, and important updates.
2.3 Account Security
You're responsible for:
- Keeping your password secure
- All activity on your account
- Any content you create or upload
Never share your login credentials. We can't recover data lost due to compromised accounts.
2.4 What You Can Do With Your Account
You own all the data you create:
- Tasks and journal entries
- Budgets and financial data
- Ads you create
- Any files you upload
We just store and process it to provide you the service.
3. Shopify Integration
3.1 You Must Have Shopify
LunitonAI only works with Shopify. You need an active Shopify store to use our platform.
Don't have one? Create a store at shopify.com first.
3.2 What Data We Access
When you connect your Shopify store, we access:
- Store information (name, domain, settings)
- Products and inventory
- Orders and customer data
- Sales and analytics data
We use this data to power your dashboard, forecasts, AI insights, and all our features.
3.3 You're Still Responsible for Shopify
You must follow Shopify's rules. We're not responsible for:
- Shopify downtime or issues
- Changes to Shopify's API or policies
- Your Shopify subscription fees
- Problems with your Shopify store
3.4 Integration Reliability
We do our best to keep everything synced, but:
- Shopify API changes might affect our service
- Data sync might be delayed sometimes
- If Shopify cuts off our API access, we may have to stop the service
3.5 Disconnecting Shopify
If you disconnect your Shopify store:
- Many features will stop working
- Your data stays in LunitonAI for 30 days
- You'll still be billed unless you cancel separately
To fully cancel: Uninstall our app from Shopify AND cancel your LunitonAI subscription.
4. Plans and Features
4.1 Our Plans
We offer three subscription tiers:
Starter Plan:
- Basic dashboard and KPIs
- Up to 50 tasks
- Manual impact journal entries
- Basic AI Assistant (limited queries)
- Up to 250 SKUs
- Budget tracking (basic)
Growth Plan:
- Everything in Starter
- Unlimited ad creation in Ad Studio
- Advanced AI Assistant (more queries, all agents)
- Up to 1,000 SKUs
- Advanced analytics and forecasting
- Priority email support
Scale Plan:
- Everything in Growth
- Up to 10,000 SKUs
- Advanced forecasting
- Custom reports
- Priority support

4.2 Plan Limits
Each plan has limits (number of SKUs, AI queries, tasks, etc.). If you hit your limit:
- We'll email you when you're at 80% usage
- You can upgrade anytime
- We won't delete your data if you go over
- Some features might be temporarily restricted
4.3 Upgrading
Upgrade anytime:
- Instant access to new features
- Pay prorated difference for the current period
- No refunds for unused time on old plan
4.4 Downgrading
Downgrade anytime:
- Takes effect at your next billing date
- You keep current features until then
- No refund for current period
Important: If you have more data than your new plan allows (like 500 SKUs but downgrading to 250 SKU limit), excess items become read-only until you delete them or upgrade again.
5. Pricing and Payments
5.1 How Billing Works
- Monthly: Billed every 30 days, pay in advance
- Annual: Billed once per year, pay in advance
- Save 2 months: Pay for 10 months, get 12 months of service
5.2 Price Changes
We might change prices. If we do:
- You get 30 days notice by email
- New price starts on your next billing date
- Annual plans: price change happens at renewal, not mid-year
- Don't like it? Cancel before the new price kicks in
5.3 Payment Processing (Stripe)
All payments go through Stripe. We don't see or store your credit card. By subscribing, you agree to:
- Stripe's terms: stripe.com/legal/ssa
- Stripe's privacy policy: stripe.com/privacy
We're not responsible for Stripe issues or processing failures.
5.4 Failed Payments
If your payment fails:
- We'll email you immediately
- We'll retry 3 times over 10 days
- After that, your account gets suspended
- You have 15 more days to fix payment
- After 30 days total, we'll delete your account
Keep your payment info current!
5.5 Taxes
Prices don't include taxes (VAT, sales tax, etc.). Taxes are added at checkout based on your location. You're responsible for any taxes we don't collect.
5.6 Free Trial
New users get 14 days free on the Growth plan.
How it works:
- Full access to Growth features for 14 days
- No credit card required to start
- One trial per business/email/Shopify store
- Cancel anytime during trial, no charge
After 14 days:
- If you added payment: You get charged and continue with your chosen plan
- If you didn't add payment: Account downgrades to limited free tier (view-only, no new features)
- We'll email you 3 days before trial ends
No trial abuse: Creating multiple accounts for extra trials will get you banned.
5.7 Refunds
For EU Customers:
You have 14 days to cancel and get a refund (EU consumer law). Email lunitonai@gmail.com within 14 days of subscribing. We'll refund within 14 days. If you used the service during those 14 days, we'll charge for what you used.
After 14 days:
- Monthly: No refunds (but cancel anytime to stop future charges)
- Annual: No refunds for unused months
For Non-EU Customers:
No refunds, except:
- Billing errors (we'll fix it)
- Major outages lasting 72+ hours
- If we mess up badly
We might refund at our discretion, but we're not required to.
To request a refund: Email lunitonai@gmail.com with your account email, Shopify store, and reason.
6. Canceling Your Account
6.1 How to Cancel
Cancel anytime:
- Go to Settings → Account → Cancel, OR
- Email lunitonai@gmail.com
- Monthly: Cancellation takes effect at end of current 30-day period
- Annual: Cancellation takes effect at end of 12-month period
You keep access until the period ends. No refunds for the current period.
6.2 If We Cancel Your Account
We might suspend or terminate your account if you:
- Violate these Terms
- Do illegal stuff
- Don't pay
- Abuse the service
- Harm other users
We'll usually warn you first (unless it's serious fraud/illegal activity).
6.3 What Happens to Your Data
Days 1-30 after canceling:
- Your data stays intact (read-only)
- You can export everything
- You can reactivate without losing data
After 30 days:
We permanently delete everything:
- Your Shopify data
- Tasks, budgets, journal entries
- Ads and templates
- AI conversation history
- All uploaded files
This is permanent. We can't recover it.
We keep for 7 years (for legal/tax reasons):
- Invoices
- Basic account info
- Transaction records
Want immediate deletion? Email lunitonai@gmail.com with "Immediate Deletion Request" – we'll delete within 48 hours (you lose the 30-day recovery window).
7. Your Data and Privacy
7.1 What Data We Collect
Your account data:
- Name, email, business info
- Billing address (payment info handled by Stripe)
From your Shopify store:
- Products, orders, customers
- Sales and analytics data
What you create in LunitonAI:
- Tasks, budgets, journal entries
- Ads, reports, settings
7.2 Your Privacy Rights (GDPR)
You can:
- Access your data: Download everything at Settings → Privacy & Data
- Fix incorrect data: Update at Settings → Account
- Delete your data: Request deletion anytime
- Export your data: Get JSON/PDF/CSV exports
- Stop processing: Ask us to limit how we use your data

7.3 How We Protect Your Data
- AES-256 encryption (data at rest)
- TLS 1.3 encryption (data in transit)
- Secure backups
- Limited employee access
No system is 100% secure, but we do our best.
7.4 Who We Share Data With
We use these services to run LunitonAI:
- Shopify – Your ecommerce platform
- Stripe – Payment processing
- Google Gemini – AI processing (anonymized data only)
- Anthropic Claude – AI insights (anonymized data only)
- Hosting and email providers
We NEVER:
- Sell your data
- Share it with competitors
- Use it for our own marketing
7.5 Data Outside EU
Some of our services (AI providers, Stripe) are in the USA. We use Standard Contractual Clauses (approved by EU) to protect your data during transfers.
7.6 How Long We Keep Data
- Active account: As long as you're subscribed
- Canceled account: 30 days, then deleted
- Legal records: 7 years (invoices, transaction records)
8. Intellectual Property
8.1 You Own Your Stuff
You own everything you create:
- Your Shopify data
- Tasks, budgets, ads
- All content you upload
We just store it to provide the service.
8.2 What We Own
We own:
- The LunitonAI platform and code
- Our design and interface
- Our AI models and algorithms
- Our logo and branding
You can't copy, reverse engineer, or steal our stuff.
8.3 AI-Generated Content
You own AI outputs (ad copy, insights, forecasts) and can use them freely for your business.
You can't:
- Resell AI outputs as a product
- Use them to build a competitor
- Claim you made them entirely yourself
We might generate similar outputs for other users – AI recommendations aren't exclusive.
9. AI Features and Disclaimers
9.1 What Powers Our AI
- Google Gemini for data analysis and forecasting
- Anthropic Claude for conversational AI and insights
- Our own algorithms for ecommerce-specific intelligence
9.2 AI Is Not Perfect
IMPORTANT: AI can be wrong.
AI might give you:
- Incorrect forecasts
- Bad recommendations
- Biased outputs
- Complete nonsense (called "hallucinations")
We don't guarantee:
- Accuracy of AI predictions
- That following AI advice will make you money
- That demand forecasts will be right
- That AI-generated ads will perform well
- That SEO suggestions will improve rankings
YOU are responsible for:
- Verifying AI recommendations before using them
- Making your own business decisions
- Not blindly following AI advice
- Getting professional help when needed (lawyers, accountants, etc.)
AI is a tool to help you, not replace your judgment.
9.3 Your Data and AI Privacy
We protect your privacy when using AI. Before sending data to AI providers (Google, Anthropic):
- Customer names → Replaced with numbers (e.g., "Customer 2334")
- Emails, addresses, phone numbers → Removed
- Payment info → Never sent
We NEVER:
- Send your raw customer data to AI
- Use your business data to train third-party AI models
- Share your strategies with competitors
AI sees anonymized, aggregated data only.
9.4 AI Liability
We're not liable if:
- AI forecasts are wrong and you lose money
- AI ad suggestions don't work
- You stock too much/too little based on forecasts
- AI recommendations hurt your business
- You make bad decisions based on AI
Use AI as one input in your decisions, not the only input.
10. What You Can't Do
Don't use LunitonAI to:
Illegal stuff:
- Break any laws
- Sell illegal products
- Commit fraud
- Launder money
Harmful stuff:
- Harass or threaten people
- Spread malware or viruses
- Spam or phish
- Violate others' privacy or IP rights
Platform abuse:
- Create multiple accounts to get around limits
- Share your account across businesses
- Hack or reverse engineer our platform
- Scrape our data
- Resell our service
AI misuse:
- Generate spam or misleading ads
- Create deceptive content
- Try to break our AI
- Use AI outputs to compete with us
Violate third-party rules:
- Shopify's terms
- Advertising platform policies (when we add those integrations)
Consequences: We'll terminate your account, possibly take legal action, and report serious violations to authorities.
11. Third-Party Integrations
11.1 Current Integrations
Right now: Shopify only (required)
Coming soon:
- Meta Ads (Facebook/Instagram)
- Google Ads
- TikTok Ads
- Email platforms (Klaviyo, Mailchimp)
- Google Analytics
11.2 Third-Party Responsibilities
You need valid accounts with integrated platforms. We're not responsible for:
- Their downtime or issues
- Changes to their APIs
- Your account problems with them
- Their fees
11.3 Platform Compliance
You must follow their rules:
- Shopify's Terms
- Meta's Ad Policies
- Google's Ad Policies
- etc.
Our integration doesn't exempt you from their requirements.
11.4 Ad Platform Disclaimers
When we add ad integrations:
- We don't guarantee ad approval
- We don't control ad performance
- Ad spend is charged by them, not us
- We're not liable for ad results
You're responsible for managing your ad budgets on those platforms.
12. Disclaimers and Limits
12.1 "As-Is" Service
LunitonAI is provided "as is" with no warranties. We don't guarantee:
- The service will always work perfectly
- AI will be accurate
- Integrations will never break
- You'll make money using our platform
12.2 Limitation of Liability
We're not liable for:
- Lost profits or revenue
- Lost data (though we back up regularly)
- Business interruptions
- AI giving bad advice
- Third-party platform failures
- Any indirect damages
Our maximum liability to you: The amount you paid us in the last 12 months, or €100, whichever is greater.
Exceptions: We're still liable for things we can't legally disclaim (like fraud, gross negligence, or death/injury we cause).
12.3 You Indemnify Us
If someone sues us because of something you did (violated laws, infringed IP, illegal products, etc.), you'll cover our legal costs and damages.
13. Disputes and Legal
13.1 Try to Resolve It First
Before suing, email lunitonai@gmail.com. We'll try to work it out.
Give us 30 days to resolve it informally.
13.2 Where We Resolve Disputes
- For EU customers: You can bring a case in your home country courts or where we're located.
- For non-EU customers: Disputes go to courts where we're located or binding arbitration (your choice).
- EU Online Dispute Resolution: EU customers can use ec.europa.eu/consumers/odr
13.3 No Class Actions
You agree to resolve disputes individually, not as part of a class action (where legally permitted).
14. General Terms
14.1 Changes to These Terms
We might update these Terms. If we do:
- We'll email you 30 days before changes take effect
- Material changes require you to accept new terms
- Don't like the changes? Cancel within 30 days
Continued use = you accept the changes.
14.2 Entire Agreement
These Terms + our Privacy Policy = the full agreement. They replace any prior agreements.
14.3 If Part of This Is Invalid
If a court says part of these Terms is invalid, the rest still applies.
14.4 We Can Assign These Terms
We might transfer these Terms to another company (like if we get acquired). You can't transfer them without our permission.

By using LunitonAI, you confirm:
- You've read and understand these Terms
- You're at least 18 years old
- You have authority to agree (for yourself or your business)
- You understand this is a binding legal agreement
- You know AI can be wrong and you verify recommendations
- You have or will create a Shopify store
- You understand our refund and data deletion policies
If you don't agree, don't use LunitonAI.
